In a major 140 page decision, a Federal District Court judge in the Northern District of New York find that many of New York’s new gun control laws including its “sensitive places” rules were unconstitutional and, thus, would be enjoined from enforcement pending the completion of the lawsuit. The NY Defendants then sought an emergency Stay (or pause) preventing the lower court’s decision from going into effect. The Court of Appeals for the Second Circuit granted NY’s request for an emergency stay. The Antonyuk plaintiffs then took an emergency appeal to the US Supreme Court asking that the Second Circuit stay be vacated as improperly granted.
